1. Purpose

Sabaican is practice-management software for massage therapists and physiotherapists practising in Canada. It covers clients, appointments, health forms, session notes and invoicing.

2. Acceptance

By creating an account on Sabaican, you accept these terms. If you do not accept them, do not use the service.

3. Your account

You are responsible for keeping your credentials confidential. Any action taken from your account is deemed to be yours. Report any compromise immediately to support@sabaican.com.

5. You are responsible for what you enter

The information you enter into Sabaican — client records, health forms, session notes, uploaded documents — is your professional responsibility. You must be entitled to record it, and must never place information about another person in a client’s record. Sabaican does not review the content you write.

6. Suspension of the service

Sabaican may suspend or close an account for non-payment, abusive use of the service, or breach of these terms. A suspension cuts off access to the service and ends open sessions; it deletes nothing. What happens to your data is described in section 10.

7. Health data, roles and PIPEDA

You remain the owner of the data entered into Sabaican (clients, forms, notes). You are responsible for your practice’s compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and with the applicable provincial laws.

Sabaican acts as a service provider on your behalf: we access your data only to deliver the service or to meet a legal obligation, and we notify you without delay of any unauthorized access. In Ontario, this role is that of an electronic service provider under PHIPA.

Health data is encrypted at rest with AES-256-GCM. The encryption key is managed by Sabaican; a compromise of Sabaican’s infrastructure creates a risk to the encrypted data (see the privacy policy).

8. Availability and backups

Sabaican makes reasonable efforts to keep the service available, but guarantees no service level during the free trial.

An encrypted database backup is produced automatically at most once a day and kept for 7 days. Files uploaded into client records are not included in that backup. Sabaican guarantees no restore time and encourages you to keep your own copies of important documents.

9. Trial and pricing

Every new account starts with a free trial. Its length and the current prices are shown at sign-up and in your account, under Subscription. Nothing is charged automatically: Sabaican stores no credit card.

10. Closing your account and your data

When your account is closed, access to the service stops immediately. Within 90 days you may request a full export of your data. After that, Sabaican anonymizes your clients’ contact details and keeps encrypted, without accessing it, the health records and accounting records for the period set out in the retention schedule, so that you can answer a request from your college or the tax authorities. You may ask in writing for complete destruction; we will then remind you that such destruction may put you in breach of your college’s rules.

11. Liability

Sabaican is provided “as is”, without warranty of fitness for a particular purpose. Sabaican’s liability is limited to the amounts you actually paid Sabaican over the previous 12 months. During a free trial, that limit is therefore nil.

12. Changes

Sabaican may change these terms. Any significant change will be notified by email at least 30 days before it takes effect.

13. Governing law

These terms are governed by the laws in force in Ontario, Canada. Any dispute will be brought before the competent courts of Ontario.
